By making a reservation or using our Service, you consent to these Terms. If you do not agree to any part of these terms, you should not use the Service.

2. Service Overview

CommonsHarborside offers luxury yacht charter services, such as:

  • Day-to-day yacht hire
  • Evening sails
  • Business retreats
  • Exclusive gatherings
  • Extended excursions

Our services are contingent on availability and favorable weather conditions. We may alter or terminate services without prior notice.

3. Booking and Reservations

3.1 Booking Process

When reserving a charter, you are required to:

  • Have reached the age of majority, at least 18 years old
  • Supply truthful and comprehensive details
  • Provide the stipulated deposit as noted in your reservation confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

A confirmation of your reservation comes into effect only after we have received payment and sent a written acknowledgment. We retain the right to decline service to any individual at our discretion.

3.3 Availability

Chartering is subject to the availability of vessels and appropriate climate conditions. We shall exert reasonable efforts to meet your requested dates and times.

4. Payment Terms

4.1 Pricing

All quotes are given in € and include taxes unless stated otherwise. Prices may vary without previous notification.

4.2 Payment Schedule

  • Initial Deposit: 50% of the entire charter fee required upon reservation
  • Remaining Balance: Payable 48 hours prior to the departure of the charter
  • Any other charges (as applicable): Payable upon the charter's end

4.3 Payment Methods

We accept most credit cards, wire transfers, and certified bank drafts. Our secure, encrypted procedures handle payment procession.

5. Cancellation and Refund Policy

5.1 Client Cancellations

  • Beyond 72 hours pre-departure: Full reimbursement less transaction fees
  • Within 24 to 72 hours of departure: Partial refund of 50%
  • Under 24 hours prior to departure: No reimbursement available

5.2 Weather Cancellations

Should the captain deem weather conditions unsafe, our options include:

  • Rescheduling your charter to another suitable date at zero additional charge
  • Issuing a complete refund if rescheduling is not feasible

5.3 Mechanical Breakdowns

If there are mechanical issues with the assigned yacht, we will try to provide an appropriate substitute. Should no replacement be available, we will issue a full refund.

6. Safety and Conduct

6.1 Safety Protocols

All passengers are expected to:

  • Adhere to instructions from the crew
  • Don appropriate safety gear as demanded
  • Disclose any medical conditions impacting their safety
  • Stay within the designated areas on the vessel

6.2 Forbidden Items

The items prohibited on the yacht include:

  • Containers made of glass
  • Unlawful substances
  • Weapons of any kind
  • Overindulgence in non-alcoholic beverages (beyond a reasonable quantity for consumption)
  • Animals (except with prior authorization)

6.3 Behavior

Passengers should act respectfully at all times. If any passenger's conduct endangers safety or interrupts others' enjoyment, the charter may be terminated prematurely without a refund.

7. Liability and Insurance

7.1 Our Responsibility

Our accountability is confined to the charter cost paid by you. We are not responsible for events including:

  • Injuries to persons resulting from their own carelessness
  • Loss or damage to personal belongings
  • Indirect, secondary, or penal damages
  • Delays from weather or situations outside our influence

7.2 Insurance

Comprehensive insurance covers our fleet and operations. Travel and personal insurance responsibility lies with the passengers.

7.3 Risk Acknowledgment

Your participation in our services implies that you recognize marine activities have innate dangers and you accept liability for your welfare and safety.

8. Itinerary Adjustments

Based on climatic conditions, security measures, or operational demands, we may revise routes, schedules, or itineraries. We will strive to offer equivalent alternatives wherever feasible.

9. Force Majeure

Occurrences outside of our control such as severe climate, natural catastrophes, governmental regulations, dock shutdowns, or vessel breakdowns do not hold us accountable for delays, cancellations, or changes.

10. Privacy and Data Security

We handle your personal data as per our Privacy Policy. Using our services indicates agreement with the collection and use of your data as outlined in our Privacy Policy.

11. Intellectual Assets

Our website features content such as text, visuals, insignias, and imagery protected under copyright and trademark legislation. Without our explicit consent, you are barred from copying, distributing, or creating derivative works.

12. Applicable Legislation

The laws of France dictate these Terms. Disputes shall be settled in the courts of Grimaud, France.

13. Modifications to Terms

We reserve the right to alter these Terms as necessary. Any updates will appear on our website, noting the revision date. Continual use of our services indicates your agreement to these changes.
